sorry for the hi-jack aerial0 - but you will be fine though you just have to figure out your angel of attack

I do andy. the cats just too busy with other traffic and cops and you have those distance / speed camerias now plus to short. Have you rode the A683 - A684 ?

If they have proof, there really is no way around it - its very difficult to get away on a technicality nowadays, and mitigating circumstances don't come into it. I recently got flashed by a camera whilst being towed - and I'm waiting to hear from that little beauty! :twisted:

I doubt that the funding cuts will last long with regard to speed cameras, once our government realise how much out of pocket they'll be ... :roll:

You can either just bend over, plead guilty and pay the fine/accept 3 points, or you can have your day in court and try to plead mitigating circumstances.

However it is very likely that a punishment inflicted by the court will be more severe than the fixed penalty £60/3 points if you are found guilty (which you undoubtedly will be unless you can prove that the camera wasn't calibrated or that the operator was doing something wrong or was untrained).

Courts don't like their nice friendly policemen challenged though, especially by motorcyclists and other anarchists, so will take a dim view of miscreants trying to avoid the drop pleading technicalities.

I would take legal advice first from a motorcycle friendly solicitor (some good ones advertise in MCN) before taking a final decision. Also ask for the proof and ask if it is a fixed or mobile camera (no room for pleading operator error with a fixed site!).

By a rope. I only saw one flash, so I think I might be ok. However I can prove without doubt that the car was not a runner, and I therefore had no control of its speed.

Depending on the length of rope it may show your vehicle still within the calibration lines on the road, therefore the towing car will be the offender and recieve the NIP. If not you will recieve it. This is when you`d have to enter your mitigation and details of the person towing you. This is one of the reasons that the number of the towing vehicle should be on the vehicle being towed.

And the guy in front happens to have Malaga number plates ;)

Not that I have any spare Malaga plates in my garage, just below the shelf with my crash helmets, and above the shelf with my spare trackday fairings :roll:

Some speed cameras only flash once so you can't be sure if you have been caught or not. If you don't get an NIP in 3 weeks you should be clear.
Towing is a nightmare legally and you should hope that you don't get an NIP. Being towed you are still 'driving' so still need to have insurance, MOT, tax and all the usual guff. If you were caught speeding whilst being towed by rope it opens up all sorts of 'undue care and attention' or even 'dangerous driving' allegations :(

My car is insured, taxed and mot'd. I am pretty sure I can plead that, if I had hit the brakes to slow down, it could have had a dangerous effect on the car of the kindly Malagean gentleman who was towing me.
