My mates 08 lightning had a similar fault a few weeks ago. The engine management light was on solid< not flashing> and the active exhaust valve motor on top of the air box was buzzing continuously but it started and ran ok.
On taking the ex valve motor apart one of the plastic cogs had broke up, and the electric motor inside it was running constantly when connected to the wiring harness hence the noise. Harley wanted about £180 for a new one. So we wired the valve on the exhaust itself open and got an ex valve emulator from Adrealin Moto this plugs in instead of the standard ex valve motor and just switches the engine management light off. If you have ecmSpy you can turn the light off with it and save yourself some money, £31 I think.
The bike is now a bit louder but runs fine.

It seemed to fix itself since I sprayed the ignition switch with WD40, no problems for the past month or so
